What cybersecurity duties do New York lawyers have?
New York Rule of Professional Conduct 1.6(c) requires lawyers to make reasonable efforts to prevent inadvertent or unauthorized disclosure of, or access to, confidential information. New York also requires one credit hour of Cybersecurity, Privacy and Data Protection CLE in each biennial reporting cycle for attorneys, effective July 1, 2023. Your firm should confirm its own obligations with its ethics counsel.
